Art. 1 – Identification of the Seller

Art. 2 – Scope of application

2.1 These General Conditions of Sale apply to all sales made by the Seller on the fiorditerra.com website.

2.2 Where permitted by the site, entering your tax code implies that you are acting as a Consumer pursuant to Article 3, paragraph 1, letter a) of the Consumer Code. Entering your VAT number implies that you are making a purchase as a Professional, pursuant to Article 3, paragraph 1, letter c) of the Consumer Code.

2.3 Delivery times are understood to be working days. Images and descriptions are indicative and colors may vary depending on the device used.

2.4 These Terms and Conditions may be modified at any time. The applicable version is the one published on the website at the time of the order.

2.5 The applicable General Conditions are those in force at the time the order is sent.

2.6 The user is required to read these Conditions carefully before each purchase.

2.7 The Seller is not responsible for any indirect damages resulting from the use or failure to use the site.

2.8 All contents of the site are the property of the Seller or third parties. Any unauthorized reproduction is prohibited.

Art. 3 – Purchases on the site

3.1 The purchase is made following the procedure indicated on the website. The contract is considered concluded upon the arrival of the order on the Seller's server.

3.2 The user undertakes to report any improper use of his/her credentials or personal data.

3.3 The user guarantees the accuracy and completeness of the data entered. The Seller reserves the right to refuse orders from users who have violated these Conditions.

3.4 Acceptance of the Conditions is mandatory to complete a purchase.

3.5 The sales contract is concluded between the user and Fiorditerra.

3.6 The Seller does not guarantee the continuous functioning of the site, which may be subject to maintenance.

3.7 After purchasing, the user will receive an email with the summary details of the order.

Art. 4 – Product availability

4.1 Available products are limited in number. The site may allow pre-orders, which require advance payment.

4.2 In the event of unavailability, the Seller will inform the user and may propose a deferred delivery, an alternative product, the issuing of a voucher or a refund of the amount.

4.3 In case of refund, this will be made within 15 days.

Art. 5 – Prices

5.1 Prices include VAT and are expressed in euros.

5.2 Prices may be updated at any time, but the price applied will be the one in effect at the time of the order.

5.3 Any pricing errors will be communicated to the user, who will be able to accept the change or cancel the order.

Art. 6 – Payment methods

6.1 The following payment methods are accepted: bank transfer, PayPal, and cash on delivery (cash on delivery).

6.2 Payments are secure and handled through certified external circuits. Card details are not processed or stored by the Seller.

6.3 Payment by bank transfer must be made within 3 business days. Otherwise, the order will be cancelled.

6.4 Cash on delivery has an additional cost of €3.50 and is not available for orders over €199.

6.5 Discount codes may be entered, where applicable.

6.6 Refunds will be made to the same payment method used.

Art. 7 – Shipping costs and methods

7.1 Deliveries are made throughout Italy via express courier, including BRT, GLS, or other equivalent logistics operators, based on the destination and service availability.

7.2 Shipping costs:

• €7.90 for orders up to €98.99
• Free shipping on orders of €99.00 or more
• For cash on delivery (Cash on Delivery), a fixed surcharge of €3.50 applies, regardless of the order amount.

7.3 Delivery times vary from 2 to 7 working days, with a maximum of 30 days.

7.4 The user is required to check the integrity of the package upon delivery and report any damage within 24 hours and report.

7.5 Upon delivery, the user is required to verify the integrity of the package. Any damage or tampering must be immediately reported to the courier by marking the package with the words "ACCEPTED WITH SUBJECT TO INSPECTION."

8. RIGHT OF WITHDRAWAL (For Consumers)

If you purchase as a Consumer, you have the right to withdraw from the contract without penalty and without specifying the reason within 14 days of receiving the products.

Return Policy

After submitting your request, you must return the products at your own expense within 14 days to the following address:

Products must be returned intact, unused and in their original packaging..

Reimbursement

We will refund the full amount paid for returned products within 14 days of notifying us of your decision to return them. The refund also includes the shipping costs incurred at the time of purchase, at the standard rate, which is the cheapest shipping method we offer. The refund will be made using the same payment method used for the initial purchase.

Note: As required by law, we may withhold reimbursement until we have received the products back at our warehouse or until you have demonstrated, through appropriate documentation, that you have sent them back.

Defective or incorrect products (Legal Guarantee)

If you receive a defective, damaged, or incorrect item, please contact our customer service immediately. In this case, we will cover the entire cost of returning or replacing the item.

Art. 9 – Manufacturer's warranty

9.1 Any commercial or manufacturer guarantees will be reported in the product description.

Art. 10 – Force majeure

10.1 The Seller shall not be liable for failures or delays in the performance of the contract caused by force majeure events, including, but not limited to, strikes, pandemics, fires, floods, earthquakes, power outages, telecommunications network disruptions, or orders from public authorities. In such cases, the deadline for performance will be suspended for the duration of the event.

Art. 11 – Applicable law and competent court

11.1 The contract is governed by Italian law and the Consumer Code.

11.2 Consumers have jurisdiction over their place of residence. Professionals have jurisdiction over the courts of Viterbo.

14.1 These Terms constitute the entire agreement between you and Fiorditerra. Any mandatory rights provided by law remain unaffected.
